Peru votes to legalise betting and igaming – Legal & compliance

The Peruvian Congress has resolved to legalize online gambling and sports betting in the country and establish a new regulated framework for the sector.

Approval took place on July 15, after discussions in parliament. The law approving the industry received 91 votes in favor and 0 votes against.

The new law will be the responsibility of Peru’s Ministry of Foreign Trade and Tourism (Minsetur), the country’s foreign trade body that regulates the enactment in Peru.

The game tax is set at 12% of the tax base of each business. This is your net income minus maintenance costs and is collected monthly.

The maintenance tax is 2% of the business’s monthly income.

Sunat, the tax authority in Peru, manages taxes.

An operator with the appropriate license can offer bonuses to online games as long as the bonuses cannot be exchanged for money.

For sports betting, operators should display a warning message on all platforms that “excessive online sports betting can cause pathological gambling.”

The law also allows players to set up remote sports betting rooms where players can bet on sports games using betting terminals.

Violations of this law can result in warnings, fines of up to SOL200 (£ 42.79 / € 50.47 / $ 51.24), license disqualification for up to 10 years, or permanent disqualification for minor violations.

Mincetur also has the authority to impose precautions on operators, such as the temporary closure of offices and the confiscation of assets.

This law will come into effect 60 days after it is published in the official bulletin, El Peruano.
