The Government of New South Wales has proposed new betting and racing legislation that classifies special odds and welcome offers as a banned incentive to gambling.
The proposed gambling and horse racing methods make it clear that gambling ads should not encourage people to gamble. Under these rules, welcome offers that require users to create accounts are prohibited, and the Liquor and Gaming Bureau considers them to present “new opportunities for gambling-related harm.”
Similarly, the law prohibits “special odds” for similar reasons.
In addition, operators will not be able to broadcast ads during certain sporting events.
Violations of these rules can result in fines of up to A $ 15,000 for businesses and A $ 5,500 for individuals.
The Liquor and Gaming Authority has the authority to determine if an ad is considered to be in breach of this ban.
The proposed proposal also defines regulatory aspects that were not defined in the 2012 edition. This includes the term sports management agency.
Kevin Anderson, Minister of Liquor, Games and Racing Law, can approve an application as a sports management body for sporting events.
Sports management organizations must also notify the Minister of changes in circumstances.
Meanwhile, the Totalizer Regulation Bill authorizes the distribution of gambling information brochures and the display of notices related to counseling services in all areas of facilities offering totalizer gambling.
Gambling in New South Wales is currently regulated by the 1998 Gaming and Horse Racing Act and the 2012 Gaming and Horse Racing Regulations, as well as the 1997 Totalizator Act and the 2012 Totalizator Regulations.
The rule will expire on September 1, 2022. If successful, the new rules (Betting and RacingRegulation2022 and TotalizatorRegulation2022) will support both laws.
These were developed by the New South Wales Liquor and Gaming Authority and are set to take effect when previous regulations expire.
Public consultation allows industry stakeholders to provide feedback on any element of regulation proposed through the Have Your Say website.
Participants can participate in the consultation by responding to the online survey and responding in writing on the website or by mail.
The deadline for submissions to public consultation is June 22, 2022. Significant developments that may occur as a result of the consultation will be announced after this date.
